Isn't it time we ENFORCE our laws on gay marriage?
gay marriage is illegal in most states, but I was shocked to hear that nothing is done about it. The only consequence is that the state will not give you a marriage license. But gay couples can still get married and everything. Isn't it time we have some jail or at least heavy fines for gay couples that get married in violation of the law?

If you mean cohabitation most of those laws are gone. The ones that remain would probably be struck down as unconstitutional if states tried enforcing them.
you know... even this deep-red ass-end of the universe that is North Dakota "decriminalized" cohabitation in 2007 (and a good thing too, I don't wanna go to jail). In this century, we don't imprison people for not legally marrying. Anybody is allowed to throw a gigantic commitment party.
There is no law AGAINST gay marriage as in "gay marriage is forbidden". you'll be surprised to know that unless the law stated so "marriage" per se wouldn't even mean shit to the public administration.
So it isn't like "gay marriage is illegal" it's more like "gay marriage isn't even contemplated and has no legal validity, the state does not and will not recognise it. Apart than that you can do whatever the fuck you want" as in they can get married in church, they can make believe they are married they can fuck, suck and fondle all day long, but their union will not be considered factual by the state. that's all there is.
And if there was any sense in all this (and there can't be any ince it's religion we are talking about) it would be the same for heterosexual marriages: marriage in church doesn't count, if you want to get married in front of the state you have to get married in a courthouse.

If the state doesn't supply a marriage license then you're not married. The local witch doctor can dance about, yell magic words, and rattle his bones all he wants but in America it is the secular state that makes a marriage legitimate.
No marriage license = no marriage.
They can have a commitment ceremony though, but it others no rights, which is why they want to be able to get married!

Don't get me wrong, I fully support legalising gay marriage, but as long as the state doesn't recognise it isn't that the way the law would view the matter?
I suppose not, come to think of it - since the state doesn't even recognise the possibility of gay marriage, could they prosecute you for fraudulently claiming to be something it's not legally possible to be, and thus nobody could be expected to be fooled by?
This, my dear, is called oppression. Or, to be more exact, tyranny of the majority. I highly doubt the US constitution and its amendments allow for it.

@Brain In a Jar: Additionally, there's probably the issue of "marriage" having a vernacular meaning vs. a legal meaning. Y'know, the same reason most contracts have a "Definitions" section that give specific exacting definitions for a bunch of words that people know already.

This is part of the problem. These people see no distinction between religious commitment ceremonies and legal marriage. Therefore, most of them believe that if states allow gay marriage their churches would be forced to perform the ceremonies. They need to learn the distinction. Of course, this would also require them to comprehend the separation of church and state so they could understand that allowing civil gay marriage would not require any church to perform gay ceremonies.

He says he will but even if seperate but equal werent insulting I predict certain states doing everything possible to make things difficult for these couples.
Personally my solution would be to completely seperate marriage from civil unions. You want the legal benefits, tax benefits, etc, you get a civil union, (available to gay or straight), you want a marriage, you find a church, witchdoctor, internet minister, etc willing to perform it (again, gay or straight). The fundies wouldn't be forced to perform gay, interracial, or athiest marriages, the gays would actually have the same rights as everyone else, everybody wins.

Um...not even close . Obama has not suggested that he will even make a move to let us get partner health benefits if we're employed by the government. He's gone so far as to go on the record stating that marriage should be for heterosexuals only.
He's perfectly happy to keep us around to provide entertainment and fill the occasional non-politically-valuable appointed office, and he definitely wants the support of our friends and family, but he's opposed to anything better than second-class status for us.

That means that your driver's license is good in every state, and if you went to Vegas for a quickie wedding, your home state would have to recognize it as legal. That said, if a gay couple in your state went to Massachusetts or Connecticut and got married, they would by law be married in your state. It's no more a crime than the Vegas wedding chapel with the Elvis impersonator.
This, fucking this, is why I so often go on tirades about the difference between RELIGIOUS marriage and LEGAL marriage. People who say "marriage is a religious issue, not a legal one" should be willing to give back their marriage licenses, health insurance, tax breaks and inheritance rights. They'll still be married in the eyes of the church, and supposedly, that's all they care about, right?
any couple without a proper marriage license are simply not married under the law, regardless of what ceremony they conduct.
Not sure about broom jumping though, is that still on the books ? and common law marriage of course.
