It is the person's responsibility to ask and make sure their partner is healthy. A person with HIV does not have the obligation to reveal their medical history to someone.
This man should not go to jail.

The OP trips and falls onto tall grass/a bush. He finds - painfully - sticking out of his arm/leg a used syringe thrown away in such a public place.
Walking barefoot on the beach, he treads - painfully - onto a used syringe left in the sand: where children play.
It is the OP's responsibility to make sure that the entire area they are about to enter is free from such bio hazards. A person with HIV from dirty needles does not have the obligation to put their used syringes in the proper receptacle.
The latter person should not go to jail.

But there's a limit to how many questions you can ask your partner.
Do you have any of the following diseases?
Do you have any of the following mental conditions?
Do you have a jealous (ex- or current-) boyfriend/girlfriend/significant other who is a cop and likely to be armed when/if they catch us?
Do you keep venomous snakes and when's the last time you checked the lock on its/their cage?
Are you now or have you ever been romantically involved with one or more bikers.
It's difficult to imagine all the possible threats that one partner may be hiding.
And even if you do ask them, they could still lie.
If a person KNOWS something may pose a risk to their partner, it's THEIR duty to share this information. They don't have to share their entire medical, mental, social history, but it is THEIR fault if they bring harm to another.

Person A buys Person B a drink
Person A sets intensive interview process for person B
Person B does likewise for Person A
Person A has comprehensive medical
Person B has comprehensive medical
Upon receipt of test results
Person A and Person B have wild night of unbridled sexual passion.

Sure, you might have responsibility to ask, but you have much, much more responsibility to actually TELL when you know you're not healthy.

Yes. They do. Full stop. "You never asked" is not a valid defense for why you didn't tell your partner that you have a horrible, incurable, life-altering disease. Life isn't a fucking comedy sketch (hard as that is to believe with fools like yourself on the stage).
Putting aside the fact that, Yes, he DOES have that responsibility, there's nothing in that story that indicated that they DIDN'T ask. How do we know that they didn't ask him, and he just lied to their faces?
