Sadly, that question almost certainly DOES get asked of the (alleged) victim in rape trials, but even just ASKING it conveys an assumption that she was asking for it . I swear, if I were a judge presiding over such a case, and the defense asked the girl that question, I would call the counsels to the bench and give a blistering lecture on the subject, with the jury present. Whatever the girl is wearing (or not wearing) has no bearing on whether the guy had her expressed consent for sex.
Also, the claim that rapists tend to attack women who are immodest is just flat-out untrue! They attack according to opportunity and safety (for them), not according to attractiveness or wantonness of the victim. Elderly women home in bed don't get raped because of immodesty, but they DO get raped!

This type of comment has always struck me as doomed to create exactly the kind of problem it is intended to condemn -- or, at least, to make sure that the worst possible degree of what it condemns becomes as likely as the most innocuous one.
After all, if people think that dressing attractively commits the same offense as adultery, then they will quickly conclude that sleeping around on their spouse is no worse than having their ankles visible, so what's the big deal? That's nuts! It's as bad as saying that just glaring in rage at someone is worthy of the same sentence as having killed that person. Man, I'd hate to get one of these folks on a jury!

I'm fairly certain that in Canada, the victim's dress style is not permitted to be inquired about by the defense lawyer, or the victim's sexual history, unless there is fact essential to the defense (for example, a woman with an extensive history of psychiatric care often accused people of raping her: there was a case where this was a factor in NS some time ago, but in that instance I believe the defendant was found guilty).

A rape victim's character or dress is not a justification or excuse for rape in any court I know. In fact, blue shield laws typically exclude much of that from even being presented at trial (at least in the US). The exception and possible way around that is for when the defense tries to ruin the victim's credibility as a witness.
