There is nothing as precious in the world as a forming baby in its mother's womb. In the Old Testament, if two men were fighting and a pregnant womb sustained an injury that hurt her unborn child, God required an eye for an eye, and a tooth for a tooth, in retribution (Exodus 21:22-25). If the child died, so did the two men! That is God's way of justice, capital punishment! That shows how much God respects life!!!

Looks like death is only called for if 'mischief follows' the original punishment, if said mischief results in death.

Talion principle justice, or as you uneducated Christian Bible thumper would say, "eye for an eye", is and was the most prevelant justice system in the Near East, documented as far back as 4000 BC, not only in your precious Bible.
You should thank your sweat Jesus that the USA doesn't use that justice system. If it did, your punishment for sexually assaulting that little girl would be something equal in retribution, like ramming a broomstick up your ass 100 times until you broke in half.

No, Kiddydiddler, if the fruit departed (i.e. a miscarriage), it was just payment to the man who lost the future child.
In Biblical times, so many kids died before their fifth birthday, it was no use investing too much in them before that time.
In seahorses, the forming of babies happen in their father's "womb" (or pouch).
I assume you realize that there is a difference between someone striking a pregnant woman and causing a miscarriage and the woman choosing, for reasons of her own, to terminate her own pregnancy.
Even so, the passage is unclear. From the NIV:
“If people are fighting and hit a pregnant woman and she gives birth prematurely but there is no serious injury, the offender must be fined whatever the woman’s husband demands and the court allows. But if there is serious injury, you are to take life for life, eye for eye, tooth for tooth, hand for hand, foot for foot, burn for burn, wound for wound, bruise for bruise."
This translation makes it seem like the "serious injury" refers to the child or the woman. But other translations, in particular the NRSV, translate "gives birth prematurely" as "miscarriage." In that case it's clear that the "serious injury" in question refers to the woman and not the child.
