And for the most part it is. It's "by the people" as we elect those who represent us. The government seems to have some trouble with the "for the people" part at times though, but in general it works as intended.

Perhaps you're unaware that sodomy, among other things, was illegal in various places in the U.S. for quite some time. I believe it's still "on the books" in some areas. You'll also note, no doubt, that almost never was anyone charged with such a thing and when they were there's likely only a handful of times where it stuck.
