Religious nuts have given religion a bad reputation. To avoid that reputation the nuts have taken to claiming what they do is not religion. In addition, they put all other (false) religions in the "religion" category, while their own (true) religion, not being false, must be something other than a religion.

Because they can't understand anything except as a twisted mirror image of themselves, they can only understand other belief systems as religions. Also they have a dim awareness of how ludicrous their beliefs are and try to discredit atheism by associating it with the religion label.

One of the fundie memes that has been spreading in the last few years that Christianity isn't a religion, it's a personal relationship with Jesus. Religions are bad belief systems, filled with rules and required beliefs. That's how they can call atheism a religion and say that Christianity isn't.
I haven't encountered a church willing to give up first amendment protections or tax-exempt status, though.

The "Christianity isn't a religion" thing is thoroughly stupid by now, but it started as (IMO) a good thing - it's just been hijacked by fundies. There was a movement that wanted to back Christianity away from the heavily structured "organized religion" stuff and try to move back towards Jesus' original teachings. Unfortunately it got completely taken out of the context where it made some sense and hijacked as a way to argue for a theocracy. *headdesk*
So, in some places, you see some people using that saying to support really theocratic ideas, others using it in a much more liberal way (i.e. "we don't need all this legalism and prohibitions").
