Well, he/she/it is right about one thing, atheism is a philosophy, not a religion. However, I don't think that "freedom of religion isn't freedom from religion" argument would hold up in the supreme court.
Hmmmm....attempting to legislate the compliance of religion by criminalizing atheism...? That's a new one.
Oh, and here's a clue...most stuff in the world is not a "religion," from politics to what you had for lunch to the very Constitution itself. Show me where in the Constitution it says that anything non-religious is illegal.
And while atheism is not a "religion," it is a religious stance, and so would be covered anyway.
One could multiply counterexamples almost infinitely.
Most democratic constitutions protect freedom of the press. Therefore, not reading a newspaper is unconstitutional.
Most democratic constitutions protect against ethnic and racial discrimination, therefore being racially or ethnically ambiguous is unconstitutional.

And I'd like to add that, contrary to popular opinion, the world is NOT the US, and some of us don't give a shit about your constitution.
I'm God, and even I say that he is insane! I am going to put this into more correct terms. With freedom of religion comes the choice to be affiliated with a religion at all! Just because you don't associate yourself with a religion, doesn't mean you are breaking the law. In fact, you are exercising that Amendment just as much, if not more, than a Christian. The first choice in deciding what religion you want to be affiliated with, is deciding to be affiliated with a religion at all.

No, Mr. Cub, the Constitution is rather explicit on this matter.
The exact wording of the First Amendment regarding religion is as follows:
Congress shall make no law respecting an establishment of religion , or prohibiting the free exercise thereof...
Congress can't establish an official religion or promote any one religion over other religions or lack of religion.
You might also want to check out Amendment Number Nine:
The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.
...which makes it clear that not including a specific right in the Constitution does not mean you don't have it; freedom to believe whatever it is that you believe is one of the most fundamental freedoms in existence, since you can't change your beliefs with an act of will.
Also take a peep at the 10th Amendment.
The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.
If the Constitution doesn't explicitly say that the federal government has a particular power, then it doesn't have that power; either the states or the people do.

Mind you, if he's like a lot of fundies, he probably thinks Sci-fi and anime should be unconstitutional.

Freedom of religion is, by its very nature, freedom FROM religion. After all, you're free to not be a Muslim, right?
IIRC, the Supreme Court HAs said that FOR THE PURPOSE OF RELIGIOUS FREEDOM< atheism counts as a religion.
And for simple logic, freedom of religions demands freedom from religion.
Simple example: Catholics use wine for communion. Mormons use fruit juice. Or water. But even in Utah, Mormons cannot legislate that Catholics use water. And in Massachusetts, the Catholics cannot legislate that the Mormons use wine.
Because both are free to practice their religion without having to obey the strictures of a religion they don’t practice.
