I'm afraid you are not understanding the reality of what atheism essentially is. Atheism is non-belief, you can primarily tell what someone believes by what they practice. There is a large percentage of people who call themselves Christians, Muslims and Jews and yet they are equivalent to being atheist by what they practice. The prison population is full of Atheist by way of hypocrisy. Hypocrites and Atheist are spiritual equivalents.

No, if they believe in a god, regardless of how they behave, they are not atheists. They may not measure up to your personal view of how a religious person should act, but they are not atheists.

No, if one believes in a god, one is not an atheist.

No. People who profess religious belief, but do not believe are not my "spiritual equivalents," they are liars.
I´m sorry, but the number of chaplains in the prison shows you not. And just as a matter of fact, an ashtounding percentage were church-going people, specially the Spanish speaking sector and muslims. Now, atheist is a person who is not affiliated with any church. From that onward, judging other people´s faith is a waste of time, because if we enter in subtleties, I could tell that fundamentalist Christians are killers, since they are the only ones in the pro-life movement that bomb clinics.

In other words, believers never commit crimes, because anyone who does anything bad is not a real believer. He's redefining "atheist" to mean anyone who doesn't live a perfect life, even if they're a Bible-thumping evangelical. "No true Scotsman" award, for sure.
The US is the most punitative society on this planet. There are about 2 million prisoners, 500,000 or so have untreated medical disorders and should be in hospitals not prisons. The courts are backed up past any degree of functionality and 95% of cases are angled towards plea bargains to lesser charges, which people plead guilty to whether they're innocent or not, to avoid months or years in jail waiting for a trial date, which is not compensated for if they're found innocent. Most plea cases revolve around absurdly inappopriate probation periods to avoid prison overcrowding, yet completely curtail their chances of ever getting a decent job or a real chance at life. Without probation, there would be over 5 million prisoners.

Hey, sure... you can spin anything to mean anything else. Sure, it does not change the fact of the matter, but it buys you some time to pull that tail in between your legs and run for the hills. Additionally, isn't christianity about believing in christ's sacrifice? If so, simply believing in that makes you a christian. What "practices" are you refering to exactly?

Well, even if all Muslims, Jews, Hindus and whatnot were to be considered "atheists", there'd still be a lot less "atheists" in jail than Christians. Think about it.
People are either honest or dishonest, religious tag not relevant. George W Bush has commited many criminal acts but justifies them all from the bible.

There's an awful lot of supposedly pious Muslims in jail, to account for the rest of that 18.98% of the US prison population, then.
For someone who claims to be a Muslim, you have no problem with having a Buddhist name. Islamists and hypocrites are spiritual equivalents.
