Kitzmiller V Dover was not about evolution but rather trying to sneak creationism into science classes in violation of the constitution.

the theory of evolution is a main theory of biology and accepted by most biologists. No one cares what others think of it.

Scopes lost the legal case because he did, in fact, violate the law. The case was a disaster for fundamentalists though because it revealed that even the most prominent boosters of creationism are unable to defend the validity of creationism in an objective setting. That trend has continued unabated ever since. The only difference is that creationists have gotten better about manipulating the forums in which they promote their lies (this seems to be Kent Hovind's sole talent) and and altering the language, though not the content of their rubbish to try and make it more widely palatable (hence the need for the Kitzmiller vs. Dover decision).
Court is not usually where you decide over scientific matters, and it's not part of the scientific method.
There is no "case" of Theory of Evolution, stupid. There is just the Theory of Evolution. As it's deemed a scientific theory, it is already "proven enough". If it hadn't enough evidence in its favor, it would still be called hypothesis.

‘Enough?’ PROOF is kinda binary. It’s proven or it’s not. Nothing in science is PROVEN. But there’s no question that it’s happened.

It’s done very well under peer review. SO, if the Jury iand judge and defending ocunsel were biologists, and the prosecutor a creationist, it’d be tossed out in 5 minutes.
