Police can conduct a Terry stop and pat down for "officer safety." The cops should be more creative in citing a "reasonable suspicion of criminal activity" when stopping blacks. That would sidestep the constitutional issue. It's not hard to have a suspicion of on-going criminal activity when it comes to confronting blacks; they are ALWAYS up to something.
