Yeah, it’s almost as if there was another amendment passed which essentially applied the Bill of Rights to all of the states, explicitly made nationality and citizenship an issue for the federal government only, and also prohibited those who encouraged or participated in rebellions against the government from holding public office unless given congressional approval.
Also the people who wrote the 1st amendment were pretty explicit about not using public money for religion or using the government to favor any one type of religious expression. So using your “originalist” ideology shouldn’t we apply it the way it was intended and how they understood it? Or are you going to do more pseudo-history by professionally trained lawyers not professional historians to prove that it just so happens their views are the same as yours?
