Death of nonbinary teen Nex Benedict after school fight is ruled a suicide, medical examiner says

OKLAHOMA CITY (AP) — The death of a nonbinary student the day after a fight inside an Oklahoma high school restroom has been ruled a suicide, the state medical examiner’s office said Wednesday.

A summary autopsy report was released more than a month after the death of 16-year-old Nex Benedict, a student at Owasso High School. Family members said Benedict had been bullied at school and the teenager’s death in February drew concern from LGBTQ+ rights groups, as well as attention from Oklahoma’s governor and the White House.

“From the beginning of this investigation, Owasso Police observed many indications that this death was the result of suicide,” Owasso Police Department Lt. Nick Boatman said in a statement. “However, investigators did not wish to confirm that information without the final results being presented by the Oklahoma Medical Examiners Office.”

In a 911 call on Feb. 8, Sue Benedict — the teen’s grandmother and legal guardian — had expressed concern about a head injury. The teenager was conscious and alert after the fight a day earlier when they told police about the attack by three girls that occurred after the teen squirted them with water, according to police video released last month.

Two teachers in eastern Germany tried to counter the far-right activities of students at their small town high school. They counseled bullies who threatened to beat up immigrant classmates. None of it helped. In desperation, Laura Nickel and Max Teske wrote a public letter in which they described an atmosphere of intimidation at Mina Witkojc School in Burg. They reported students greeting each other with the Nazi salute, scratching swastikas on their desks and playing music with racist lyrics in the hallways

“Teachers and students who openly fight against far-right students and teachers fear for their safety,” the two said in the letter they sent to local newspapers. “The problem has to be recognized and openly fought. Schools should be places free of fear, full of open-mindedness and safety for everyone and cannot provide a home for the enemies of democracy”

Missouri’s Republican-led House on Wednesday voted against banning minors from openly carrying firearms on public land without adult supervision.

The proposal to ban children from carrying guns without adult supervision in public failed by a 104-39 vote. Only one Republican voted in support of it.

Democratic Rep. Donna Baringer said police in her district asked for the change to stop “14-year-olds walking down the middle of the street in the city of St. Louis carrying AR-15s.”

“Now they have been emboldened, and they are walking around with them,” Baringer said. “Until they actually brandish them, and brandish them with intent, our police officers’ hands are handcuffed.”

“While it may be intuitive that a 14-year-old has no legitimate purpose, it doesn’t actually mean that they’re going to harm someone. We don’t know that yet,” said Rep. The mother of a California teenager conspired with a former Missouri boarding school dean on a plan that resulted in the boy being forced into a car, handcuffed for more than 24 hours and driven to a Missouri school for troubled youths, federal prosecutors said Wednesday.

The indictment accuses Shana Gaviola, 35, and Julio Sandoval, 41, of violating a protective order issued at the request of Gaviola’s son. If convicted, both could face up to five years in prison and $250,000 fines.

The indictment out of California, unsealed Tuesday, stated that Gaviola’s son had been living with another family since 2020. He had petitioned for emancipation from his mother and obtained a domestic violence protection order against her in July 2021.

The indictment said that despite the order, Gaviola and Sandoval conspired to take the boy to a Missouri boarding school. It stated that people working on behalf of Gaviola and Sandoval found the boy at a Fresno business in August 2021, handcuffed him and forced him into a car. He allegedly remained handcuffed for the entire 27-hour trip to Stockton.

The indictment said the boy was held at the boarding school for eight days until his father was able to free him.

Kansas legislators impose sweeping anti-trans bathroom law

TOPEKA, Kan. (AP) — Republican legislators in Kansas enacted what may be the most sweeping transgender bathroom law in the U.S. on Thursday, overriding the Democratic governor’s veto of the measure without having a clear idea of how their new law will be enforced.

The vote in the House was 84-40, giving supporters exactly the two-thirds majority they needed to override Gov. Laura Kelly’s action. The vote in the Senate on Wednesday was 28-12, and the new law will take effect July 1.

At least eight other states have enacted laws preventing transgender people from using the restrooms associated with their gender identities, but most of them apply to schools. The Kansas law applies also to locker rooms, prisons, domestic violence shelters and rape crisis centers.

Republican legislators argued that they’re responding to people’s concerns about transgender women sharing bathrooms, locker rooms and other spaces with cisgender women and girls. They repeatedly promised that the bill would prevent that.

Kansas House Speaker Dan Hawkins, a Wichita Republican, told GOP colleagues after the vote that the override was “truly the icing on the cake” among conservative policy victories this year.

“I’m just giddy,” he said.

The Kansas law is different than most other states’ laws in that it legally defines male and female based on the sex assigned at birth and declares that “distinctions between the sexes” in bathrooms and other spaces serves “the important governmental objectives” of protecting “health, safety and privacy.” Earlier this week, North Dakota enacted a law that prohibits transgender children and adults from having access to bathrooms, locker rooms or showers in dormitories of state-run colleges and correctional facilities.

Kansas’ law doesn’t create a new crime, impose criminal penalties or fines for violations or even say specifically that a person has a right to sue over a transgender person using a facility aligned with their gender identity. Many supporters acknowledged before it passed that they hadn’t considered how it will be administered.

Lawmakers in Hungary approved legislation Tuesday that prohibits sharing with minors any content portraying homosexuality or sex reassignment, something supporters said would help fight pedophilia but which human rights groups denounced as anti-LGBT discrimination.

Fidesz, the conservative ruling party of Hungarian Prime Minister Viktor Orban, introduced the legislation, which is the latest effort to curtail the rights of gay men, lesbians, bisexual and transgender people in the European Union nation located in central Europe.

Hungary’s National Assembly approved the bill in a 157-1 vote. Fidesz has a parliamentary majority, and lawmakers from the right-wing Jobbik party also endorsed the measure. One independent lawmaker voted against it.

Csaba Domotor, the Fidesz state secretary, described the goal as “the protection of children,” noting that the changes include the introduction of a searchable registry of convicted pedophiles.

“Pedophiles won’t be able to hide any more – there are similar solutions in other countries, too. The criminal code will be even more strict. Punishments will be more severe. No one can get away with atrocities with light punishments and parole,” he said.

MARYSVILLE, Mich. (AP) — A city council candidate in Michigan said Friday she has no plans to end her campaign after shocking a public forum when she said she wants to keep her community white “as much as possible.”

Jean Cramer made the comment Thursday in response to a question about diversity in Marysville, a city in St. Clair County, 55 miles (88 kilometers) northeast of Detroit. The Times Herald in Port Huron said she’s one of five candidates running for three council seats in November.

More than 90% of Marysville’s 9,700-person population is white.

During a follow-up interview Friday outside her Marysville home, Cramer doubled down on her statements. She said if there is a biracial marriage in their family, she could understand why her stance might upset her neighbors.

“Because those people don’t know the other side of it,” she said. “For whatever reason, I’ve heard, they love each other, whatever, but there’s also such a thing as remaining single. People don’t necessarily have to get married, and, if they love somebody, love them single. There’s nothing wrong with that.”

Cramer, 67, contends the bible backs her beliefs and asserts she doesn’t believe she is a racist, despite the condemnation of her views.

“As far as I know, as long as we’ve been here, Marysville has been a white community, a white city,” she said. ”. If we have seen a black person here and there, whatever, we’re not bothered by it. I’m not bothered by it.”

Cramer made her comments about keep Marysville as white as possible Thursday after the moderator asked candidates if the city should do more to attract foreign-born residents.

“Keep Marysville a white community as much as possible,” she replied. “White. Seriously. In other words, no foreign-born, no foreign people.”

The Times-Herald later asked Cramer if she wanted to clarify her remarks.

“Husband and wife need to be the same race. Same thing with kids,” she said. “That’s how it’s been from the beginning of, how can I say, when God created the heaven and the earth. He created Adam and Eve at the same time. But as far as me being against blacks, no I’m not.”

RICHMOND, Va. (AP) — Jerry Falwell Jr. announced his resignation Tuesday as the head of Liberty University after a provocative photo and revelations of his wife’s extramarital affair roiled the evangelical school founded by his father.

Falwell’s exit marks a precipitous fall from power for one of the country’s most visible conservative Christian leaders and ardent supporters of President Donald Trump. He confirmed his decision to resign in a wide-ranging interview with The Associated Press.

According to the school, he initially offered to resign Monday, hours after a news outlet published an interview with a man who said that he had a yearslong sexual relationship with Becki Falwell and that Jerry Falwell participated in some of the liaisons as a voyeur. Falwell, who denied any participation, later reversed course on his resignation and began telling news outlets he had no intention of leaving. Then he changed direction again.

“That’s the only reason I resigned: because I don’t want something my wife did to harm the school I’ve spent my whole life building,” he said in a phone interview. “I never broke a single rule that applies to staff members at Liberty, which I was. So I want everybody to know that.”

The university confirmed in a statement that its board had accepted Falwell’s resignation as president, chancellor and board member. All were effective immediately, the statement said.

Becki Falwell also spoke with the AP on Tuesday, saying she and her husband are “more in love than ever” — a sentiment echoed by an audibly tearful Jerry Falwell.

“We have the strongest relationship, and Jerry is the most forgiving person I’ve ever met,” she said. “It’s a shame that Christians can’t give us the same forgiveness that Christ gave us.”

FIFA said the Mexican Football Association must also pay a 60,000 Swiss francs ($65,000) fine.

Mexican fans persist in aiming the chant at opposing teams’ goalkeepers despite regular FIFA fines and efforts by the FA to curb the insults.

The latest incidents were during games against the United States and Dominican Republic in March at the qualifying tournament for the Tokyo Olympics that Mexico hosted in Guadalajara.

Mexico’s next two official home games are World Cup qualifiers against Jamaica in September and Canada in October.

FIFA said its disciplinary committee also opened a case against Mexico for the same chants at a friendly against Iceland last month in Arlington, Texas.

BERLIN (AP) — Germany’s leading Jewish organization expressed alarm Thursday over footage of flag-waving neo-Nazis in self-styled uniforms marching through an eastern German town on May Day unhindered by police.

Footage of the march Wednesday prompted widespread outrage in Germany and calls for authorities in the state of Saxony, where far-right sentiment is particularly strong, to step in.

“The images of the neo-Nazi march by The Third Way party in Plauen are disturbing and frightening,” said Josef Schuster, the head of Germany’s Central Council of Jews.

Noting that the rally took place on the eve of Yom HaShoah , the day when Jews commemorate the six million Jewish men, women and children murdered in the Holocaust, Schuster added that “right-wing extremists are marching in Saxony in a way that brings back memories of the darkest chapter in German history.”

German security agencies say The Third Way, a relatively small party, has close ties to far-right extremists. The march in Plauen took place to the beat of heavy drums made to look like those used by the Hitler Youth. Participants shouted slogans such as “Criminal foreigners out!” and “National socialism now!”

Saxony police said several hundred people took part in the march. Counter-protesters were kept away.

Police said they are investigating nine people for illegally covering their faces during the event and another for insulting an officer, but described the day as a success from a policing perspective because there was no violence.

Japan court upholds sterilization to register gender change

Human rights and LGBT activists on Friday denounced a ruling by Japan’s Supreme Court upholding a law that effectively requires transgender people to be sterilized before they can have their gender changed on official documents.

The court said the law is constitutional because it was meant to reduce confusion in families and society. But it acknowledged that it restricts freedom and could become out of step with changing social values.

The 2004 law states that people wishing to register a gender change must have their original reproductive organs, including testes or ovaries, removed and have a body that “appears to have parts that resemble the genital organs” of the gender they want to register.

More than 7,800 Japanese have had their genders officially changed, according to Justice Ministry statistics cited by public broadcaster NHK.

The unanimous decision by a four-judge panel, published Thursday, rejected an appeal by Takakito Usui, a transgender man who said forced sterilization violates the right to self-determination and is unconstitutional.

Usui, 45, appealed to the top court after he unsuccessfully requested that lower courts grant him legal recognition as male without having his female reproductive glands surgically removed.

Despite the unanimous decision, presiding justice Mamoru Miura joined another justice in saying that while the law may not violate the constitution, “doubts are undeniably emerging,” according to Usui’s lawyer, Tomoyasu Oyama.

The two judges proposed regular reviews of the law and appropriate measures “from the viewpoint of respect for personality and individuality,” according to Japanese media reports.

Japan is one of many countries with a sterilization requirement. In 2017, the European Court of Human Rights said 22 of the countries under its jurisdiction still required sterilization as part of a legal gender change, and it ordered them to end the practice.

Maria Sjodin, deputy executive director of OutRight Action International, which monitors LGBT rights issues worldwide, said she was unsure if all 22 of those countries have fully implemented the court’s order. She noted that Sweden, which did away with the requirement in 2013, later became the first country to pay damages to anyone forced to undergo sterilization as a requirement for gender change.

The Japanese Supreme Court decision ends Usui’s legal battle, but he and his lawyer said the opinions in the ruling left them with hope.

“I think the ruling could lead to a next step,” Usui told a news conference.

Human Rights Watch said the Supreme Court ruling was “incompatible with international human rights standards, goes against the times and deviates far from best global practices.” The New York-based group said the ruling tolerates grave human rights violations against transgender people.

The ruling was also criticized by Japan’s LGBT community.

A transgender activist and writer, Tomato Hatakeno, tweeted that the decision shows that society’s interests still come before an individual’s right to freedom regarding one’s body.

“The ruling suggests that reproductive health is not recognized as a basic human right,” she said.

There is a growing awareness of sexual diversity in Japan, but it is often superficial and generally limited to the entertainment industry. In a country where pressure for conformity is strong, many gay people hide their sexuality even from their families because of a fear of prejudice at home, school or work. Obstacles remain high for transgender people.

Japan does not legally recognize same-sex marriages. As LGBT rights awareness has gradually grown in recent years, some municipalities have begun issuing partnership certificates to ease problems in renting apartments and other areas, but they are not legally binding.

Lawmakers in the conservative ruling party have repeatedly come under fire for making discriminatory remarks about LGBT people. Earlier this year, Katsuei Hirasawa, a veteran lawmaker, was widely criticized for saying that “a nation would collapse” if everyone became LGBT. Last year, another ruling party lawmaker, Mio Sugita, was condemned after saying in a magazine that the government shouldn’t use tax money for LGBT rights because same-sex couples aren’t “productive.”

Separately, more than a dozen people with disabilities have filed lawsuits against Japan’s government for having been sterilized against their will under a 1948 Eugenics Protection Law that was in effect until 1996.

At least 16,500 people were sterilized without consent under the law, which allowed doctors to sterilize people with disabilities and was designed to “prevent the birth of poor-quality descendants.” Some orphans were also sterilized.

The government has maintained the sterilizations were legal.

Secretive group’s leader charged with sex-trafficking

NEW YORK (AP) — The leader of a secretive group in upstate New York turned female followers into brainwashed “slaves” who were branded with his initials and coerced into having sex, authorities alleged on Monday in a criminal complaint charging him with sex-trafficking.

Keith Raniere, co-founder of the group called Nxivm, was arrested in Mexico and returned to Texas Monday, authorities said. He was to appear in court on Tuesday in Fort Worth on the charges filed by federal prosecutors in Brooklyn.

According to the complaint, Raniere — known within the group as “Vanguard” — oversaw a barbaric system in which women were told the best way to advance was to become a “slave” overseen by “masters.” They also were expected to have sex with him and do menial chores for masters, and to keep the arrangement a secret or be publicly humiliated, the complaint says.

The name of Raniere’s attorney wasn’t immediately available on Monday. In a letter attributed to Raniere previously posted on a website related to Nxivm, he denied the practices were sanctioned by the self-described self-help group.

“These allegations are most disturbing to me as non-violence is one of my most important values,” the letter said.

The complaint said that many victims participated in videotaped ceremonies where they were branded in their pelvic area with a symbol featuring Raniere’s initials.

“During the branding ceremonies, slaves were required to be fully naked, and the master would order one slave to film while the other held down the slave being branded,” the complaint says.

Investigators said Raniere preferred exceptionally thin women, so “slaves” had to stick to very low-calorie diets and document every food they ate. As punishment for not following orders, women were forced to attend classes where they were “forced to wear fake cow udders over their breasts while people called them derogatory names,” or threatened with being put in cages, court papers say.

Raniere left the United States late last year after The New York Times reported the stories of some women who defected from their secret sorority and the government began interviewing potential witnesses. He sought to cover this trail by using encrypted email and ditching his phone, court papers say.

He was ultimately found staying with several women in a luxury gated community in Puerta Vallarta where villas can run $10,000 a week to rent, investigators say. After authorities took him into custody on a U.S. warrant, investigators said the women got into a high-speed car chase.

The website related to the group describes Raniere as a “scientist, mathematician, philosopher, entrepreneur, educator, inventor and author” who has “devoted his life to studying the human psychodynamic and developing new tools for human empowerment, expression and ethics.”

Nxivm’s Mexican affiliate is headed by Emiliano Salinas, a son of that country’s former president. Several women who belong to the group in Mexico have traveled to Albany, where they were branded, two former Nxivm members told the Times.

Salinas has also denied that the sorority is affiliated with Nxivm.

Raniere and Nxivm have been the subject of criticism for years, dating back to at least 2012 when the Times Union of Albany published a series of articles examining the organization and allegations that it was like a cult.

Over the years, Nxivm has attracted a following that includes Emmy Award-winning actress Allison Mack. Authorities also say Raniere has been bankrolled by Clare Bronfman, an heiress to the Seagram’s liquor fortune.

Bronfman gave millions of dollars covering expenses like private air travel costing $65,000 flight, court papers say.
